What to do in case the Owner's Duplicate Title is Lost?

REMEDY IN CASE OF LOSS OF OWNER’S DUPLICATE CERTIFICATE OF TITLE

If the Owner’s Duplicate Certificate of Title has been lost, the registered owner may take the following steps to secure the issuance of a new owner’s duplicate copy:

01 — FILE AN AFFIDAVIT OF LOSS

The registered owner of the property, or the latter’s duly authorized representative, should execute and file an Affidavit of Loss with the Registry of Deeds where the property is registered and have the loss annotated on the title.

The Affidavit of Loss should clearly state the circumstances surrounding the loss of the Owner’s Duplicate Certificate of Title, including when, where, and how the title was lost, based on the facts known to the registered owner.

02 — FILE A PETITION IN COURT

The next step is to file a Verified Petition for the Issuance of a New Owner’s Duplicate Copy of the Certificate of Title before the proper Regional Trial Court.

At this stage, it is advisable to seek the assistance of a lawyer because the petition must comply with the applicable legal and procedural requirements.

The allegations regarding the loss of the certificate of title must be consistent and harmonious with the facts stated in the Affidavit of Loss. Any material inconsistency may result in complications or even the dismissal of the petition.

03 — POSTING OF THE PETITION

The court will require notice to persons who may have an interest in, or may oppose, the issuance of a new Owner’s Duplicate Certificate of Title.

For this purpose, the petitioner may be required to cause the posting of the petition or notice in conspicuous places designated by the court, which may include the Registry of Deeds, Office of the Provincial/City Treasurer, Chief of Police, Office of the Barangay Captain, Office of the Provincial/City Prosecutor, and other places as may be directed by the court.

This process allows interested parties to raise any opposition or objection to the requested issuance.

04 — GRANTING OF THE PETITION

If there is no valid opposition and the court finds the petition to be meritorious and sufficiently supported by the evidence, the court may grant the petition for the issuance of a new Owner’s Duplicate Certificate of Title.

The court will issue the appropriate order directing the issuance of the replacement owner’s duplicate copy, subject to compliance with the requirements of the Registry of Deeds.

05 — COORDINATE WITH THE REGISTRY OF DEEDS

After the court grants the petition, the petitioner must coordinate with the Registry of Deeds where the property is registered.

The petitioner must submit the court order and other required documentary requirements, comply with the Registry of Deeds’ procedures, and pay the necessary fees and expenses.

Once all requirements have been properly completed and the necessary fees have been paid, the Registry of Deeds may proceed with the issuance of the new Owner’s Duplicate Certificate of Title.
